2. About Coral Future Care

Coral Future Care is a registered NDIS provider specialising in high-intensity disability support services, including complex clinical care, Supported Independent Living (SIL), and person-centred support for individuals with disability. We operate in accordance with the NDIS Act 2013, NDIS Practice Standards, NDIS Code of Conduct, and applicable Queensland legislation including the Disability Services Act 2006 (Qld) and the Human Rights Act 2019 (Qld).

3. Service Agreement

Engagement of our disability support services is governed by a separate Service Agreement entered into between Coral Future Care and the participant (or their authorised representative). These Terms complement but do not replace the Service Agreement, which contains specific details regarding service delivery, fees, cancellation policies, and participant rights and responsibilities.

4. Website Use

4.1 Permitted Use

You may use our website for lawful purposes only, including accessing information about our services, contacting us for enquiries, and submitting referrals or feedback. You agree not to use the website in any manner that could damage, disable, overburden, or impair our systems or interfere with any other party's use of the website.

These rights are protected under the NDIS Code of Conduct, Disability Services Act 2006 (Qld), Disability Discrimination Act 1992 (Cth), Anti-Discrimination Act 1991 (Qld), and Human Rights Act 2019 (Qld).

12. Service-Specific Terms

12.1 NDIS Services

All NDIS-funded services are delivered in accordance with the participant's NDIS plan, Service Agreement, and applicable NDIS legislation and regulations. Participants have the right to choice and control over their supports, and we are committed to upholding participant rights as outlined in the NDIS Code of Conduct and NDIS Practice Standards.

12.2 Fees and Payment

Service fees are determined in accordance with NDIS Price Guides and applicable pricing arrangements. Payment terms, cancellation policies, and billing procedures are outlined in individual Service Agreements. All fees comply with NDIS pricing guidelines and Queensland consumer protection laws. We reserve the right to pursue debt recovery for unpaid services in accordance with applicable laws.

12.3 Service Cancellation and Changes

Participants or Coral Future Care may terminate services in accordance with the notice periods and conditions specified in the Service Agreement. We reserve the right to suspend or terminate services if a participant's behaviour poses an immediate and serious risk to the health and safety of staff, other participants, or the community, or if NDIS funding is exhausted or unavailable. Any termination of services will be conducted in accordance with natural justice principles and relevant legal requirements.

12.4 Reasonable Adjustments

We are committed to making reasonable adjustments to ensure equal access to our services and website for people with disability, in accordance with our obligations under the Disability Discrimination Act 1992 (Cth) and Anti-Discrimination Act 1991 (Qld). 15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Queensland, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia for any disputes arising out of or relating to these Terms or your use of our website and services.

Nothing in this clause limits your rights to lodge complaints with relevant tribunals or commissions, including the Queensland Civil and Administrative Tribunal (QCAT), Queensland Human Rights Commission, or NDIS Quality and Safeguards Commission.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

17. Human Rights Commitment

While Coral Future Care is not a public entity as defined under the Human Rights Act 2019 (Qld), we are committed to respecting and promoting human rights in all aspects of our service delivery. We recognise the 23 human rights protected under Queensland law and strive to conduct our operations in a manner compatible with these fundamental rights.

We are particularly committed to upholding the rights to equality, freedom from discrimination, privacy, cultural rights, and freedom from torture and cruel, inhuman, or degrading treatment.

18. Entire Agreement

These Terms, together with our Privacy Policy, Accessibility Statement, and any applicable Service Agreement, constitute the entire agreement between you and Coral Future Care regarding your use of our website and services, and supersede all prior or contemporaneous understandings and agreements.
